These Terms and Conditions regulate the use of the service of the Internet page https://cambiandomodelos.org (hereinafter, the “Site”) that “CAMBIANDO MODELOS, A.C.”, also incorporated as “LULO MERCANTIL, S.A. DE C.V.” and holder of the trademarks “CAMBIANDO MODELOS” and/or “LOOK UP!” (hereinafter, “THE FOUNDATION”) provides free of charge to the people who visit it through the Internet.

The use of the Site confers the condition of user of the Site (hereinafter, the “User”) and expresses the User’s full and unreserved adherence to each and every one of the Terms and Conditions of the Site at the very moment the User accesses the Site. Consequently, the User must read the Terms and Conditions carefully each time he/she intends to use the Site. Access to and/or use of certain services and content offered to Users on and/or through the Site is subject to certain specific conditions which, as the case may be, replace, complete and/or modify the Terms and Conditions.

Access to and/or use of such services and contents expresses the entire and unconditional acceptance of the present in the version published by the FOUNDATION at the time of such access and/or use.

Modification of the Terms
The FOUNDATION reserves the right to unilaterally modify, at any time and without prior notice, the presentation and configuration of the Site, as well as the right to modify or eliminate, at any time and without prior notice, the services and conditions
required to access and/or use the Site and the services.

Rules for the use of the Site
The User agrees that the use of the Site shall be subject to the following rules:
1. The User acknowledges and accepts that the information published or contained in said Site shall be clearly identified, in such a way that it is recognized that it comes from and has been generated by the FOUNDATION or its suppliers. The website may contain information from external sources owned by third parties, through links or references to news pages, trademark sites, entertainment, for which the FOUNDATION is not the owner and whose contents do not generate any obligation for the FOUNDATION regarding the veracity of the information, the date of
update, personal opinions, etc.

The FOUNDATION will clearly indicate when it is external content by mentioning
to the original source, the brand or owner of the content.

However, the information, concepts and opinions published on the Site do not necessarily reflect the position of the FOUNDATION, its employees, directors, shareholders, licensees and licensees. If the User wishes to obtain further information on a specific subject provided by the FOUNDATION or its suppliers, he/she should consult directly with each of them, as appropriate, and/or with a specialist in the matter.

Copyright and Industrial Property
All information, including but not limited to images, texts, trademarks, commercial notices, domain names and designs contained in the Site is property of the FOUNDATION or has been included with the indication that it is property of third parties and the reference to the original source is included and is protected by international conventions and Mexican legislation on industrial and intellectual property.

The FOUNDATION is the sole owner of the intellectual property rights of the contents generated by itself, notwithstanding the fact that the website may contain references, links, screenshots or other elements that are external content, with respect to which all intellectual property rights of the owner of third parties will be respected.

Nothing contained on the Site should be construed as granting any license to use or right to use any of the Information displayed on the Site, and accordingly, the User agrees to refrain from:
a) Use the contents for purposes or effects contrary to law, morality and generally accepted good customs or public order;
b) Reproduce or copy, distribute, allow public access through any form of public communication, transform or modify the contents, unless authorized by the holder of the corresponding rights or it is legally required.

In case of non-compliance, the FOUNDATION will proceed to notify and/or collaborate with the authorities in the investigation and application of applicable sanctions in terms of the Federal Copyright Law and the Federal Law for the Protection of Industrial Property,
Federal Criminal Code and other applicable laws. The web page, its design, texts and source code are part of the copyright of
FUNDACIÓN. In turn, the CAMBIANDO MODELOS logos and the CAMBIANDO MODELOS and LOOK UP brands are property of the FOUNDATION.
Permissions to use the materials

Our materials include: press releases, blogs, inclusion documents, photographs, illustrations, advertising campaigns and audio, video, text and other materials (“FOUNDATION Materials”).

If you wish to quote or refer to the information on the site for academic, research or news dissemination purposes, you must notify the FOUNDATION’s Management through the contact form or by e-mail to contacto@cambiandomodelos.org. The material may be attributed when quoting as “Cambiando

Models”.
Limited use of FOUNDATION Materials is permitted, provided that the work:
– properly attributes the material used to the FOUNDATION,
– is not for commercial use, and
– is not used for derivative works.
Permission to use materials in any way does not include the use or downloading of the talent’s photographs and videos.

Liability
In no event shall the FOUNDATION be liable for any direct, special, incidental, indirect, or consequential damages that in any way arise out of or relate to:
a) The use or performance through the Site, delay or unavailability of use of the FOUNDATION.
b) The provision or failure to provide services of any information or graphics contained or published on or through the Site.
c) The updating or failure to update the information.
d) The alteration or modification, in whole or in part, of the information after it has been included in said Site.
e) Any other aspect or characteristic of the information contained or published on the Site or through the links that may be included in this Site.
f) The provision or lack of provision of other services, all of the above assumptions shall be in force, even in cases in which the FOUNDATION has been notified or warned of the possibility of such damages.
g) Internet connection failures, as well as, lack of data or access to the network due to omissions of third parties that provide the Internet service.
Model Agency Application as Talent

The personal information provided by the User in this section and in the Site in general, will be considered as strictly confidential and the FOUNDATION will never transfer or disclose it to third parties, in the understanding that by the simple fact of registering his/her information in the Site, the User authorizes the FOUNDATION to send any kind of information to the following e-mail address

Indemnification The User agrees to indemnify the FOUNDATION, its affiliates, suppliers, vendors and consultants for any action, claim or demand (including attorneys’ fees and court costs) arising from any breach by the User of
this agreement; including, without limitation of any of those arising from:

a) Any aspect of your use of the Site.
b) The information contained or available on or through such Site or any libel, defamation or other conduct in violation hereof by you in your use of the Site.
c) Violation of applicable laws or international treaties relating to copyright or intellectual property rights contained or available on or through such Site.

Content for minors
The website is suitable for minors, however, the contents of the site are not created exclusively and with the purpose of being directed to children. The navigation of the site must be monitored by the guardians or parents of minors to avoid unwanted information discharge
, acceptance of operations involuntarily, among other errors or unwanted behaviors.

Duration and Termination
The provision of the Site service and other services has an indefinite duration. The FOUNDATION, however, is entitled to terminate, suspend or interrupt unilaterally, at any time, without prejudice or need for prior notice, the provision of the service of the Site and/or any of the services.

Receipt of donations

The website allows the acceptance and management of donations in favor of the FOUNDATION electronically. The information of the donors will be kept confidential and at no time will be transferred to third parties by the FOUNDATION. The banking operation of the donation will be managed by an external service provider such as Paypal or an authorized credit institution, so it will not be carried out by the FOUNDATION directly or by itself
and the FOUNDATION is not responsible for failures in the payment systems of third parties.

The moment of acceptance to provide the donation is perfected once the action of donating is accepted, which is when the option to accept the operation through the external payment service is selected.

In case of any clarification regarding the banking service and the operation performed, the credit institution to which the account belongs should be contacted, without this representing a responsibility or burden for the FOUNDATION. In turn, the FOUNDATION may collaborate as far as possible in the clarification

Donor data will be treated in accordance with the Federal Law for the Protection of Personal Data in Possession of Individuals (LFPDPPP) and its Regulations.
In the case of receiving donations, the data of the Legal Representative(s) and, if applicable, of the Controlling Beneficiary(ies) will also be required, in accordance with the General Rules referred to in the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Proceeds (the Rules) and in compliance with the Federal Law for the Prevention and Identification of Operations with Resources of Illicit Proceeds (LFPIORPI) or “Anti-Money Laundering” Law and its Regulations. Such data may be transferred to the Tax Administration Service (SAT), if required by the authority in compliance with the legislation for the prevention of money laundering.
Updating The present Terms and Conditions, as well as the Privacy Notice, may be changed and
updated according to the needs of the company and should be reviewed in case of inclusion of structural modifications in the page. The FOUNDATION may give notice of changes through the web page itself.
Applicable Legislation and Jurisdiction

The User accepts and acknowledges that, by simply browsing the Site, any controversy or claim arising from the use of the Site shall be submitted to the jurisdiction and competence of the laws and courts of Mexico City, and therefore the User expressly waives any other jurisdiction that may correspond to him/her by reason of his/her domicile or nationality, present or future, or for any other reason.
